Trademark

At trademark is a word, phrase, symbol, or design, or a combination of words, phrases, symbols, or designs that identify and distinguish the source of the goods of one person or company from those of another. A service mark is similar, except it is used to distinguish services rather than goods.

Trademark and service mark rights are obtained through the actual use of the mark on goods or services in commerce. While a trademark doesn't need to be registered with a government agency, doing so provides additional protection for the mark.
